Law
Oman has officially adopted the Gulf Cooperation Council Trademark Law as of Monday July 31, 2017. The decision, which was promulgated by Royal Decree no. 33 of 2017, was published in the Official Gazette on July 30, 2017.
Conventions
Paris Convention, Berne, GCC Patent Office, and WIPO.
Classification
Oman follows International Classification of goods and services except class 33. A Separate application has to be filed in each class.
Duration
Registration is for a period of 10 years renewable for similar periods. A grace period of three months is allowed for renewal.
Use
Use is not compulsory for filing application or maintaining the registration. However, a registration is vulnerable to cancellation by any interested party who can establish that the mark was not in use for a successive period of 5 years without any reasonable excuse.
Assignment
Assignment of a registration shall be together with the goodwill.
License
Recording of a license is compulsory.
Infringement
Infringement of a registered trademark is an offense and an actionable wrong.
