His Excellency, the Deputy Minister for Consumer Protection at the Ministry of Commerce and Investment, Saudi Arabia (Saudi Arabia) Mr. Omar Al Suhaibani  and Khaled Al Shaia, Director of the Control Department of Online Stores at the Ministry of Commerce and Investment, Saudi Arabia (Saudi Arabia) talked about the Ministry’s strategies to protect consumers and guard against infringement and the Ministry’s fight against counterfeiting of goods in Saudi Arabia.
 
Roba Hamam, BMW Brand Protection Manager for MENA region presented the measures BMW is taking to fight against online infringement and key tactics used to take online counterfeits offline.

 

INTA’s Middle East and Africa Conference ends with a great success

The Middle East and Africa Conference organized by the International Trademark Association (INTA) Conference in Dubai was successfully concluded on the 11th of December  2018. The theme of the conference was Innovation, Investment and IP.  Speakers from around the world had a chance to speak on the importance of innovation to our daily lives, its impact on business efficiency, and strategies to protect it under Intellectual Property regime. Experts from different legal regime shared their experiences on how they handle intellectual property enforcement in coordination with government bodies.

Very useful information was shared by representatives from multi-national companies including BMW and Microsoft. The take away of the discussion was that the impact of counterfeiting cannot be constrained and analyzed from business perspectives of the right holder. The menace of counterfeiting effect every one of us in our daily lives including the impact on our health, and security as well.

The event was also graced by the presence of His Excellency Mr Omar Suhaibani, the Deputy Minister for Consumer Protection at the Ministry of Commerce and Investment in Saudi Arabia, and Mr Khalid AL Shaia Director of the Department of Control of Online Stores. In a session moderated by Mr Mohammad Jomoa, CEO of Kadasa Intellectual Property, Mr Omar Suhaibani briefed the audience on Saudi Arabia government initiatives to handle the consumer fraud in the country. His excellency while explaining the procedural mechanism and institutional infrastructure of the Saudi government also stressed public participation in fighting consumer fraud and counterfeiting issues. The audience was informed that the Saudi government encourages public participation and considers it an important input to achieve the objective of fairness in the market. The government is also awarding prizes to the selected complainants from the public on annual basis.

Speaking to the audience, Mr Khalid AL Shaia, the Director of the Department of Control of Online mentioned that the Saudi government has taken steps to counter the online infringement and counterfeiting. The government has in-place procedures to deal with online businesses with the actual presence or with no actual presence in Saudi Arabia.

Responding to a question from the participants, Mr Mohammad Jomoa, CEO of Kadasa Intellectual Property who moderated the session 9 on Anticounterfeiting: Online and Offline Enforcement explained how the Saudi legal system works against infringement and counterfeiting. He explained that under GCC Trademark Law the Saudi courts have jurisdiction to hear infringement and counterfeiting cases, however, in few cases, Courts refused to accept the cases filed before it and the Plaintiffs were asked to first file a complaint with Anti-Commercial Fraud Department (ACFD).

His Excellency, Mr Omar Suhaibani also explained why it is important to file a complaint with ACFD from investigation perspectives.

The event was declared as a success by the participants with some useful information shared by all speakers and participants.
