Law: Law No.3/1978 of April 18, 1978 on Trademarks and Commercial Data
*Trademark Law No. 9 of 2002 was issued on June 8, 2002 and published in the Official Gazette. However, the Implementing Regulations have not been issued.
Classification: Oman follows International Classification of goods and services except class 33. A separate application has to be filed in each class.
Examination: The applications are examined in form and substance. Arabic transliteration of a foreign language mark has to be filed with the application.
Duration: A registration is valid for 10 years and renewable for similar periods. A six months grace period is allowed for renewal.
Use: Use is not compulsory for filing the application or for maintaining the registration. However, a registration is vulnerable to cancellation on the request of an interested party if the owner fails to use the trademark within five consecutive years from the date of registration.
Assignment: Assignment of a registered trademark shall be with the goodwill of the business.
Infringement: Infringement of a trademark is an offense and an actionable wrong.
